Florida recount updates: Machines overheat, miss votes

Brenda Snipes

The state elections department and the Florida Department of Law Enforcement, both run by Republican appointees, have said they have seen no evidence of voter fraud.

What are the current standings?

Scott holds a narrow lead over incumbent Democratic Senator Bill Nelson in Florida but has not been declared the official victor by any state authority or major news organizations that monitor the vote.

Democrat Bill Nelson has filed a recount-related lawsuit.

If the county can't finish the machine recount, it must submit its original count with an explanation for why it failed to meet the deadline, according to Florida laws governing recounts.

As Florida officials scrambled to review more than 8 million ballots by Thursday, Trump, without providing evidence, cast doubt on the recount process.

"More fundamentally, altering a form in a matter that provides the incorrect date for a voter to cure a defect (or an incorrect method as it relates to provisional ballots) imposes a burden on the voter significant enough to frustrate the voter's ability to vote".

"It's unbelievable that this would come down to a recount", Blackwell told Washington Watch with Tony Perkins on Tuesday. But the machine recount is showing the race is much tighter than first thought and so it's likely to push the process to its next stage - a hand recount. If a county's recount in a race is incomplete, its pre-recount tally stands. Pressed on ABC's "This Week" on Sunday, White House adviser Kellyanne Conway cited "boxes of votes just appearing out of nowhere" and past criticism of Ms Snipes.

Note that not all votes are recounted in a manual recount - only those marked as undervotes or overvotes, indicating that either no candidate or two candidates were selected for any given race.

They have to make the determination on what the voter intended.

What are the parties and candidates saying?

Bill Nelson, D-Fla., outside the minority leader's suite on the second floor of the Capitol Tuesday, said that there is no pressing deadline like a meeting of the Electoral College, as was the case in the aftermath of the 2000 presidential election in Florida and the legal battle over Bush v. Gore, which ended with the Supreme Court decision that paved the way for George W. Bush's win over Al Gore.

The bitter USA election battle still isn't over a week after the vote, with Donald Trump attacking the "massively infected" process as the fight rages on.

Broward Chief Circuit Judge Jack Tuter held an emergency hearing Monday on a request by Scott's lawyers that deputies be put in charge of ballots and voting machines that aren't being used until the recount is over.

What do the lawsuits say?

Andersen was not aware that a lawsuit had been filed until he received a call from a reporter Thursday inquiring about the filing.

Election workers sort ballots at the Broward Supervisor of Elections office as the Florida midterms recount continues.

While the counting goes on, there are now four lawsuits pending in a Tallahassee federal court that seek to throw out ballot counting rules or extend the Thursday 5 p.m. deadline for recounts. Nelson and his team say the state's name-matching requirement is unconstitutional. The case was moved to federal court on Tuesday and was still pending Wednesday afternoon.

Scott's administration also includes the Florida Department of State and its Division of Elections.

How do these recounts compare to others in state history?

Once the recount is complete, if the differences in any of the races are 0.25 percentage points or less, a hand recount will be ordered, meaning it could take even longer to complete the review of the Senate race if the difference remains narrow.

It's not just Florida. The Democratic Party further told POLITICO this was a "distraction" from a "smooth recount". In Georgia, Democrats are optimistic that a recount in the governor's race will force a runoff between Democrat Stacey Abrams and Republican Brian Kemp. You can't have the close races that we have without some controversy.

"The machines are old", said Supervisor of Elections Susan Bucher, who said they underwent maintenance right before the election.
