Federal prosecutors in NY are investigating Cohen for possible bank and tax fraud, and for possible campaign law violations linked to a $130,000 payment to adult film star Stormy Daniels and other matters related to Trump's campaign, a person familiar with the investigation has told Reuters.
In recent weeks, he has taken a series of steps that have set him at odds with Trump, including hiring Lanny Davis, a Washington lawyer who is close to Bill and Hillary Clinton. One of Trump's lawyers, Rudy Giuliani, confirmed the waiver in an interview with Reuters.
"I know the substance of some of the tapes", Avenatti said on the program. The New York State Bar Association, however, considers the practice unethical.
Another person, she writes, said that Cohen's own testimony could go right to the key issues in special counsel Robert Mueller's Russian Federation investigation.

Giuliani has said no payment was made by Trump to McDougal or for her story.
At a roundtable Sunday on ABC News, the lawyer for adult-film star Stormy Daniels said that the secret recording of Trump that was revealed two days ago is far from the only one made by Trump's longtime attorney Michael Cohen. News corrected a story Thursday that said federal investigators had placed a wiretap on the phone lines of President Trump's attorney, Michael Cohen, saying it subsequently learned that the feds were only monitoring the source of calls and weren't listening in. At the time, a Trump spokeswoman said his campaign had "no knowledge of any of this".
Daniels is also suing both Cohen and Trump for defamation after the president accused her of lying about their relationship. The chairman of its parent company, American Media, is a friend of Trump. Cohen's recording was most likely legal, as NY is a one-party consent state - meaning that as long as one person involved in a conversation consents to the recording, it's legit.
"Inconceivable that the government would break into a lawyer's office (early in the morning) - nearly unheard of", Trump tweeted.
The recording was seized in FBI raids on Cohen's home and office in April as part of an investigation into Cohen's business dealings. On Twitter, he scrubbed mentions and photos of Trump from a profile that previously identified him as "Personal attorney to President Donald J. Trump".
