Immigrant Daniela Vargas to be released today

Vargas' lawyers said the terms of her release weren't immediately clear. Vargas faced deportation without a hearing, and her attorneys filed a petition in federal court demanding her release on Monday.

The 22-year-old immigration rights activist was arrested shortly after speaking at a press conference on March 1 about her father and brother, both of whom were arrested on February 15 by U.S. Immigration and Customs Enforcement (ICE) agents.

"We have not seen the order that released her, so there are technical aspects that cause doubts prior to seeing that", Elmore said, explaining it's unclear what the details or conditions of her release are.

ICE spokesman Thomas Byrd declined comment.

Daniela Vargas was in the process of renewing her application for Deferred Action for Childhood Arrivals (Daca), the Obama administration program that temporarily protects from deportation undocumented immigrants who came to the United States as children.

Vargas was brought to the U.S. by her family from their native Argentina when she was just 7, Peterson previously told BuzzFeed News. ICE's assertion that her detention is "routine" is absurd and seems anything but. A shot time after the news conference, Vargas was detained by ICE officials. ICE has said that it later learned her DACA status had expired. Peterson said that it was expected that Vargas would soon be returning home.

Vargas was being held at the LaSalle Detention Center in Jena, Louisiana, and was under threat of expedited deportation, until her surprise release around noon on Friday.

Her attorneys said she still is under an order of supervision that for now requires her to check-in next month with her local ICE office.

Attorneys at Elmore & Peterson Law Firm, which is representing Vargas, said in a statement that they "expect Daniela to return to her friends and community in MS shortly to resume her daily life and pursue her dreams".
